    Please read these terms and conditions carefully. Participation in this Promotion will constitute your agreement to comply with these terms and conditions. If you do not agree with them, please do not participate. The terms and conditions set out below apply to all participants involved in the Press Play with Stimorol Promotion. Please refer to the below Facebook page and the mobisite for the current Terms and Conditions for this Promotion:

    The Press Play with Stimorol Promotion (“the Promotion”) is conducted by Mondelēz South Africa Proprietary Limited, 6 Woodmead Estate, 1 Woodmead Drive, Woodmead, Sandton, 2191 in conjunction with Prize Voucher Agency Proprietary Limited (”Promoter”), South Africa.

    • This Promotion runs from 02 October 2023 until 31 January 2024.
    • The duration of the Promotion may be extended or curtailed at the discretion of the Promoter.
    • In order to be able to enter the Promotion and to be eligible to win a prize, the entrant must at the time of entering the Promotion
    • be a natural person and be at least 18 (eighteen) years of age;
    • be a citizen and/or legal resident of the Republic of South Africa;
    • be in possession of a valid South African Identity Document, resident/work permit and/or Driver's License; and be residing or be present in South Africa for the duration of the Promotional Period and for the period during which the prize draws and the delivery of the prize/s takes place.
    • The Promoter and/or organizers reserves the right, at any time, to verify the validity of entrants.

    To stand a chance of winning your share of R20 million in guaranteed prizes in the Promotion, eligible entrants will be required to enter the Promotion as follows:

    1. Purchase 2 participating Stimorol products to the total minimum value of R20
    2. Visit the microsite (stimorolflowlab.co.za)
    3. Complete the entry form, select the value of your purchase from the drop down menu and upload your new unique till slip. The till slip upload will need to be a clear photo of the entire slip including store name, date, invoice/slip number and 2 (two) qualifying Stimorol products to the minimum total value of R20, in order to qualify.
    4. Retain their till slip as proof of purchase in case you are drawn as one of the prize winners.

    Participating/qualifying Stimorol products include any 2 (to the total minimum value of R20 or more) of the following:

    1. Any Stimorol 10 piece stick pack including Wild Cherry, Spearmint, Air Rush Menthol, and Retro.
    2. Any Stimorol 50 or 60 piece bottle pack including Wild Cherry, Spearmint, Blueberry, Retro, and Air Rush.
    3. Any Stimorol X bottle including Peppermint or Tropical.
    4. Any Stimorol Infinity 14 piece pack including Mint, Berry, and Tropical.

      • Participation in the Promotion excludes directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoter or any third parties involved in the execution of the Promotion, either directly or indirectly (including but not limited to agencies, organizers and/or participating stores of the Promotion) as well as the members of the immediate family (being spouses, life partners, parents, children, brothers, sisters, fathers and/or mothers) and/or business partners or associates of any of the aforesaid persons.
      • In the event of a dispute, the decision of the promoters will be final, and binding and no correspondence will be entered into.
      • Promoter reserves the right to change any detail of the Promotion, without prior notice and to interpret these terms and conditions in their sole discretion.  The onus rests on the entrant to check the terms and conditions.
      • Promoter may at its sole discretion decide that any entry is not eligible due to the nature of the content of the entry and may disqualify an entrant from the Promotion.
      • An entrant may enter as many times as they wish on condition that each entry is as per the entry requirements with the submission of a completely new and unique till slip. Entrants will be allowed to win multiple daily prizes throughout the promotion, with weekly and monthly prizes capped at 1 per winner for the full campaign period.
      • The prizes are non-transferable.
      • The Promoter reserves the right to substitute any prize with another prize of similar value.

    • The guaranteed prizes are subject to the consumer uploading their new unique till slip including the store name, date, invoice/slip number and 2 qualifying products to the total minimum spend of R20.

    General Terms pertaining to the Monthly experience/travel/festival/stayover prizes include:

    • The prize winners will be chosen from a random draw of entries and contacted via telephone (using the cellular number used to enter the Promotion).
    • Should unforeseen circumstances prevent the draw from taking place on the set draw date; the draw will be moved to the next available date.
    • The Promoters decision is final, and no correspondence will be entered into. Should the winner not be contactable telephonically within 48 hours, the prize will be transferred to the next randomly selected entry.
    • For the “Fly to London to view the Piano People with Musa Keys” prize, the winner and partner/friend will be required to have valid South African passports that are not expiring within 6 months of the 17 November 2023 travel date. Should the winner not have a valid passport (and be able to submit a photo of their passport on request), they will not qualify for the prize and a new winner will be drawn.
    • Proof of eligibility, in the form of a valid South African identity book/resident permit/work permit, as well as proof of address and any other document which may be requested to enter the Promotion, must be provided to the Promoter upon request.
    • The Promoter reserves the right to disqualify anyone entering the Promotion that is not able to provide the requested documentation to the Promoter within 72 hours of the first request for documentation.
    • For the “Fly to London to view the Piano People with Musa Keys” prize, the winner and partner/friend will be required to have valid South African passports that are not expiring within 6 months of the 17 November 2023 travel date. Should the winner not have a valid passport (and be able to submit a photo of their passport on request), they will not qualify for the prize and a new winner will be drawn.
    • Transport to the departing airport is for the winner’s own account.
    • Should the winners be from a different city/region to where the experience/festival pot where the international flights are departing from, local flights to the applicable 7.6.8
    • It is the winner’s responsibility to arrive at the airport on time and no flight bookings will be rescheduled or replaced should the winner and accompanying travellers miss their flights (connecting or international) for any reason whatsoever. The winner plus accompanying travel companions must depart from the same city. city/region may be included (from major South African cities only).
    • The accommodation venue and experience company or supplier’s own terms and conditions (not listed here) will apply, and an agreement will be entered into between the winner and the supplier directly, not the Promoter or any of their agencies. The Promoter and their agencies are not liable for any loss, damages, or injuries, that may occur from accepting this prize. Any replacement fees for any damaged or lost or stolen items, will be for the winner’s own account and will not be covered by the Promoter or any of their agents.
    • Packages are subject to seasonal adjustments, currency fluctuations, flight prices and accommodation availability at the time of booking.
    • Travel costs to and from the departing airport, are not included and are for the winner’s own account. Travel insurance is not included and will be for the winner’s own account.
    • Packages do not include bar tabs, room service, in-room entertainment or mini bar fees charged on departure. These costs are for the winner’s own account if applicable.
    • Once the package has been booked, the prize is considered finalised and no adjustments or cancellations will be made.

    Prize Delivery & Redemption

    • Winners will be notified on the thank you message on the microsite once they have completed the entry form and submitted a valid slip.
    • Should the slip not include the necessary information listed under the entry requirements, not be clear or not be valid (include 2 qualifying products, the value of the purchase being R20 or more, be purchased within the promotion period, be unique, etc.) the winner will not qualify for the prize and a new winner will be selected.
    • Instant prizes include Viva Nation Subscription vouchers, Airtime, Data, TicketPro coupon codes, Concert Ticket coupon codes, and Shop and Ship coupon codes. All other prizes are subject to further moderation of the submitted slip and will take up to 5 to 7 business days to be moderated.
    • Should the submitted slip (for instant prizes) not qualify, the entrant will receive a disqualification message on the microsite.
    • Should the submitted slip (for moderated prizes) not qualify, the entrant will receive a disqualification SMS. Please allow 5 to 7 business days to receive the SMS.
    • The winners of the moderated prizes will receive an SMS, should their slip qualify, including a winning redemption code that may be redeemed on the USSD number provided, by following the prompts. Please allow 5 to 7 business days to receive the SMS.
    • The airtime will be loaded onto the cellular number that the instant winner nominates on the microsite upon receiving a message that they are an instant winner. If no cellular number is provided before the question times-out, the winner will have forfeited their prize and a new winner will be randomly drawn.
    • Data will be instantly loaded onto the cellular number that the winner used when entering the promotion on the Press Play with Stimorol microsite. The actual data amount to be loaded will be determined by the winner’s cellular service provider, but the monetary value per service provider will be as follows Cell C: R10 | MTN: R10 | Vodacom: R12 | Telkom: R14.
    • The Viva Nation Subscription voucher will be provided in a pop-up message on the microsite once the form has been submitted. The code needs to be copied from the page and saved. If the screen is closed, or the winner clicks off the message, they will not be able to access the winning voucher code again and a new unique entry will need to be made, in order to win again.     • The Concert Ticket, valued at R200, will be provided via email. As this is a manual process of emailing the tickets to each Concert Ticket winner, the ticket may take an additional 5 to 7 business days to be delivered, after the winner’s slip is verified. The Concert Ticket will need to be printed and taken along on the day of the event in order to gain access at the gate. This is for a set date, time, event and location, and the ticket may not be exchanged for an alternative event or location. Winners are chosen based on the region they submit on their entry. The Promoter is not responsible for the winner choosing the incorrect region on entry. No lost, stolen, deleted, misplaced or expired tickets will be replaced.     • The UBER EATS voucher code will be sent via SMS and may only be redeemed via the Uber app and used within cities in the Republic of South Africa where the Uber app is available. Please follow these steps to redeem the voucher: 1) Go to the Payment section in the Uber app; 2) Tap “Add Promo/Gift Code”; and 3) Enter the voucher Code. You must have an active and valid Uber account to redeem the voucher. You will be required to add a secondary payment method in the form of your bank card, to use the voucher with the Uber app in case the balance from the voucher is not sufficient to cover the price of your order.     • The Superbalist virtual vouchers will be sent via SMS and are only redeemable on www.superbalist.co.za. Vouchers are valid for 1 year from date of issue and it is the winner’s responsibility to check the issue/expiry date and to redeem the voucher within this deadline.
    • The Takealot virtual vouchers will be sent via SMS and are only redeemable on www.takealot.com. Vouchers are valid for 1 year from date of issue and it is the winner’s responsibility to check the issue/expiry date and to redeem the voucher within this deadline.
    • The Spotify subscription voucher codes will be sent via SMS and are redeemable on the Spotify app. Vouchers are valid for 1 year from date of issue and it is the winner’s responsibility to redeem the voucher within this deadline.
    • The TFG (The Foschini Group) virtual vouchers will be sent via SMS and are redeemable at any of the Foschini Group stores including but limited to Foschini, Markham, The FIX, Fabiani, Relay Jeans, G-Star Raw, Totalsports, Sportscene, Duesouth, Charles & Keith, Soda Bloc, @Home, and/or American Swiss. Vouchers are valid for 1 year from date of issue and it is the winner’s responsibility to redeem the voucher within this deadline.
    • The Netflix subscription voucher codes will be sent via SMS and are redeemable on the Netflix app. Vouchers are valid for 1 year from date of issue and it is the winner’s responsibility to redeem the voucher within this deadline.
    • The iTunes and Google Play vouchers will be sent via SMS and are redeemable on either the iTunes or Google Play App respectively. The awarding of either a Google Play or iTunes voucher to winners will be based on the participant’s registration where they are to select either iTunes or Google Play as their preference. Google Play vouchers cannot and will not be swapped for iTunes vouchers or visa versa. It is the participants responsibility to ensure they select the correct voucher type on registration and no exceptions will be made. Vouchers are valid for 1 year from date of issue and it is the winner’s responsibility to redeem the voucher within this deadline.
    • The Grocery virtual vouchers will be sent via SMS and are redeemable at any Pick n Pay store (in-store only). Vouchers are valid for 1 year from date of issue and it is the winner’s responsibility to redeem the voucher within this deadline.
    • Viva Nation, TicketPro, Webtickets, Vida é Café, Shop and Ship, Superbalist, Takealot, Spotify, TFG, Netflix, iTunes, Google Play, UBER, and PnP terms and conditions apply.
    • The weekly physical prizes will be delivered to the winner’s preferred residential or work address (within major cities) within 4 – 6 weeks from receiving all the requested documentation, including, but not limited to, a photo of their ID and proof of address. Deliveries will only be made to physical addresses (no postal addresses) where someone is able to sign for the prize on weekdays during working hours. Deliveries to high theft risk / special delivery areas will require an alternative address within a major city/town. Should the winner have no alternative address in an area that is not consider as high risk, the supplier will attempt to arrange a collection option from a pickup point within the nearest major city/town. The immediate costs (such as the cost of the prize and delivery) shall be covered by the promoter, upon delivery any further costs will pass to the winner (this includes but is not limited to insurance of the prize, maintenance, or replacement). Any risks in relation to the prizes will pass to the winner once delivered regardless of who has signed for the parcel at the specified address.
    • The promoter is not responsible for any undelivered prizes due to any incorrect details being provided by the winner with regards to their preferred delivery address or being unavailable to sign for their prize. The promoter will not be responsible for any lost, stolen or damaged prizes once the prize has been signed for. The courier may allow someone other than the consignee present at the delivery address to sign for the prize delivery if the consignee is unavailable or unreachable – it is therefore the winner’s responsibility to ensure they provide a safe low risk address/destination for delivery.
    • Winners will be required to sign Indemnities and Consent Forms when accepting their prize.
    • The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.
    • The prizes are based on set preselected models/voucher types – winners are not able to choose the model/features/specifications/colour/voucher type of the prize/s and will accept the prize as is at their own risk. Promotional images are merely a representation of the prize and the actual prize may vary. The promoter reserves the right to substitute any of the prizes for a different model/brand/voucher of similar value.
    • Should the winner notice any product defects they have 3 months to request the purchase/warranty details specific to the prize. Thereafter no recourse/claims will be allowed, and no further discussions will be entered into.
    • Prizes (including gift cards/vouchers) are not transferrable, exchangeable and may not be redeemed for cash and if not taken up for any reason, may be forfeited or be the subject of a separate draw or be allocated at the Promoters' discretion to another winner.
    • Winners of the weekly physical prizes, and the monthly prizes, will be contacted telephonically within 7 working days of the draw date, in order to verify their entry and receive a delivery address. The Promoters decision is final, and no correspondence will be entered into. Should the winner not be contactable telephonically within 48 hours, the prize will be transferred to the next randomly selected entry.
    • Finalists and winners may be required to provide their identity document and original unique till slip for their purchase, dated and timed before their entry date and time, as proof of purchase for the qualifying product. Should the winner not be able to provide a photograph of their identity document and/or original unique slip(s) to the Promoter on request, they will be disqualified. The slip(s) is not to be written on or tampered with in anyway. Validation of supporting documents and till slips by the promoter may take up to 10 working days.
    • The Promoter reserves the right to withdraw the prize and/or disqualify any participant/winner that may bring the Promoter brands into disrepute.
    • The promoter is not responsible for any undelivered vouchers and/or coupon codes due to any incorrect details being provided by the winner with regards to their cellular number, or any incorrectly redeemed vouchers, expired vouchers or Network related errors. The promoter will not be responsible for any lost, stolen or expired coupon codes, subscription vouchers or SMS vouchers and no replacements will be made.

    General:

    • The promoter and/or organizers are not liable for any technical failure that may result in an entry not being successfully submitted.
    • Any prize is accepted by a winner at his/her risk and the promoters and/or organizers are not liable, at any time, for any defect in the prize.
    • To the extent permitted by the Consumer Protection Act and any other applicable law, the entrants, users and/ or winners hereby indemnify, release and hold harmless the promoter and/or its organizers (including their subsidiaries, holding companies and affiliates), their directors, employees, agents, suppliers and contractors from and against any actions, claims and/or liability for injury, loss, damage, expense, claim or damages of any kind resulting in whole or part, directly or indirectly , form participation in the Promotion and/or the use, acceptance or possession of a prize and/or participation (or non-participation) in a prize related activity

    1.1 By using the Portal, you agree to comply with all the terms and conditions hereof.
    1.2 Use of the Portal is at your own risk.
    1.3 The right to use the Portal is personal to you and is not transferrable to any other person or entity.
    1.4 You agree to use the Portal for lawful purposes only.     1.22 Falsifying or deleting any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;
    1.23 Harvesting and collecting information about third parties, including but not limited to e-mail addresses;
    1.24 Creating a false identity to mislead others;
    1.25 Any use or action that imposes an unreasonable or disproportionately large load of traffic on the Portal, or otherwise interferes with its proper and timely functioning;

    1.28 The Portal may contain e-mail services, bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, photo albums, file cabinets and/or other messages or communication facilities designed to enable a user to communicate with others (“Communication Services”).You hereby agree to use the Communication Services only to post, send and receive messages and material that are proper.     1. INTELLECTUAL PROPERTY RIGHTS

    3.1 All content included on this Portal, such as text, graphics, logos, buttons, icons, images, photographs, audio clips, databases and software, is the property of the Company or its content suppliers and protected by South African and international copyright laws. Furthermore, the compilation (meaning the collection, arrangement, and assembly) of all content on this Portal is the exclusive property of the Company and is protected by South African and international copyright laws.
    3.2 Except as stated herein, none of the material or content of the Portal may be copied, modified, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, except as permitted by the fair use privilege under the South African copyright laws or without the prior written permission of the Company or the copyright owner.

    III. Any loss or damage with regard to participant data or any other data, directly or indirectly caused
    IV. by a malfunction of the Portal or Company’s system, third party system, power failures, unlawful access to or theft of data (despite the Company’s compliance with POPI), computer viruses or destructive code or programming defects;
    V. Any interruption, malfunction, downtime or other failure attributed to services provided by or the lack of provision of services by third parties; and
    VI. Any other event over which the Company has no direct control.
    5.5 To the full extent permissible by applicable law, the Company disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. The Company, its affiliates, members, officers and employees will not be liable for any damages (including but not limited to direct, indirect, incidental, punitive and consequential damages) and legal fees of any kind arising from the reliance on the content on the Portal, the use of the Company Portal, or any defamatory, offensive or illegal conduct of other users or third parties.

    1. JURISDICTION

    6.1 These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa without giving effect to the principles of conflicts of laws. You hereby consent to the exclusive jurisdiction of the High Court of the Republic of South Africa in respect of any disputes arising in connection with this Portal.

    1. TERMINATION

    7.1 The Company may terminate your User account at any time for any reason, including for any improper use of this Portal or your failure to comply with these terms and conditions.
    7.2 Such termination shall not affect any right to relief to which the Company may be entitled in terms hereof or at law.
    7.3 Upon termination of these terms and conditions, all rights granted to you will terminate and revert to the Company.

    8 PROTECTION OF PERSONAL INFORMATION

    8.1 The Company respects the privacy of all users that visit and use the Portal. As a result, the Company would like to advise you of the way it would use your Personal Information. By submitting your Personal Information to the Company, you will be deemed to have given your permission – where necessary and appropriate – for the disclosures referred to in this clause 8. By visiting and using this Portal, you acknowledge that you have reviewed the terms hereof, and more specifically this clause 8, and that you consent to the use of the Personal Information and agree that the Company may collect, use and transfer your Personal Information in accordance herewith.

    9.1 In the event that any of the terms of this Agreement are found to be invalid, unlawful or unenforceable, such terms will be severable from the remaining terms, which will continue to be valid and enforceable.
    9.2 These Terms and Conditions, including any documents referenced herein, represent the entire agreement between you and the Company regarding the subject matter hereof and supersedes any prior statements or representations.
    9.3 The Company may at any time modify these Terms and Conditions and your continued use of this Portal will be conditioned upon the Terms and Conditions in force at the time of your use.

    1. LEGAL DISCLAIMER

    10.1 Any agreement entered into will always by actioned by way of a Board Resolution. If same is not actioned by a Board Resolution, it will not be a valid agreement.
    10.2 It is your responsibility to ensure that all agreements are valid as per the above requirement.
